Can I ask for goodwill deletion with debt collectors?
If you've repaid a debt and the collection account remains on your credit report, you can request a goodwill deletion from your creditor, though there's no guarantee they'll grant your request.
Briefly explain the situation that caused the error. Explain the steps you took to correct the issue and ensure it wouldn't happen again. Mention how it's negatively affecting you, like if it's hindering your ability to qualify for a mortgage. Ask for a “goodwill adjustment” to have it removed.
Goodwill letters are more likely to work for smaller negative items, such as late or missed payments. That's because many creditors have agreements with credit bureaus that they will not negotiate with individuals to have repossessions, collection accounts or charge-offs removed in exchange for payment.
You cannot remove collections from your credit report without paying if the information is accurate, but a collection account will fall off your credit report after 7 years whether you pay the balance or not.
Specifically, section 609 of the FCRA gives you the authority to request detailed information about items on your credit report. If the credit reporting agencies can't substantiate a claim on your credit report, they must remove it or correct it.
Your lender is not obligated to honor your goodwill adjustment request or help remove negative marks from your credit report. “It's likely they could say yes; it's likely they could say no, and I think there's an equal chance of either response,” McClary said.
Goodwill letters describe what life circ*mstances kept you from making a payment on time or caused you to miss a payment. They include a kind request to the creditor or collection agency to remove the resulting negative mark on your credit report. Though these letters rarely work they're still worth a try.
Don't give a collector any personal financial information. Don't make a "good faith" payment, promise to pay, or admit the debt is valid. You don't want to make it easier for the collector to get access to your money, or do anything that might revive the statute of limitations.
It varies. A well-written goodwill letter can often persuade a creditor to help, but there's no guarantee.
Without the "goodwill" of a creditor to remove those marks, they remain on your credit report for seven years — though the impact on your score fades with time.
How do I get a collection removed immediately?
- Step 1: Ask for proof. There needs to be evidence that the debt is genuinely yours to pay for it to stay on your credit report. ...
- Step 2: Look for and report inaccuracies. ...
- Step 3: Ask for a pay-for-delete agreement. ...
- Step 4: Write a goodwill letter to your creditor.

Most negative items should automatically fall off your credit reports seven years from the date of your first missed payment, at which point your credit score may start rising. But if you are otherwise using credit responsibly, your score may rebound to its starting point within three months to six years.
A 623 dispute letter is a written communication submitted to a credit bureau, typically by a consumer, to dispute inaccuracies or discrepancies in their credit report.
A pay for delete letter is a negotiation tool intended to get negative information removed from your credit report. It's most commonly used when a person still owes a balance on a negative account. Essentially, it entails asking a creditor to remove the negative information in exchange for paying the balance.
What is the 609 loophole? A 609 dispute letter is a written request to credit bureaus to remove inaccurate items from your credit report under section 609 of the Fair Credit Reporting Act (FCRA).
At present, I intend to buy a house. But, due to the negative listings from my past late payments, I am not being able to get a reasonable mortgage rate. So, I humbly request that you remove this negative item from my credit report as a gesture of goodwill. I would sincerely appreciate if you consider my request.
Goodwill letter requests are sent to creditors, not credit card bureaus. Only the creditor that reported the late payment can remove the negative mark. By removing the late payment, you can continue to build up your credit without the consequences of a negative mark.
If you'd like to expedite the process, you can request a goodwill removal. Removing a paid collection account is up to the discretion of your original creditor, who doesn't have to agree to your request. Some creditors aren't able to delete collections from a credit report at all. But it doesn't hurt to ask.
Another guideline for creating effective goodwill messages is known as the five S's of goodwill messages. This guideline states that goodwill messages should be short, sincere, specific, selfless, and spontaneous.
Are goodwill adjustments legal?
The Bureau's consumer-facing information actually has a Q&A on this topic indicating the consumers cannot have negative but accurate information removed from their reports. While credit unions hate to disappoint members, it appears that requests for “goodwill adjustments” do represent a real risk of noncompliance.
Technically, pay for delete isn't expressly prohibited by the FCRA, but it shouldn't be viewed as a blanket get-out-of-bad-credit-jail-free card. "The only items you can force off of your credit report are those that are inaccurate and incomplete," says McClelland.
Debt collectors cannot harass or abuse you. They cannot swear, threaten to illegally harm you or your property, threaten you with illegal actions, or falsely threaten you with actions they do not intend to take. They also cannot make repeated calls over a short period to annoy or harass you.
Even if you owe money, debt collectors aren't allowed to threaten, harass, or publicly shame you. You have the right to order a debt collector to stop contacting you, and they must comply. If there's a mistake, and you really don't owe the debt, you can take steps to remedy the error.
Lawsuit: The collection agency could bring a debt collection lawsuit against you, potentially leading to a wage garnishment and a freezing of your bank accounts and assets.
